1. General Provisions

1.1. This Agreement defines the general provisions of the online service for providing electronic money exchange services Ant.Exchange (hereinafter referred to as the Executor).

1.2. The Executor owns the script for currency exchange, hosted on an Internet server.

1.3. A Client is considered any user who wishes to and uses the services of the Executor.

1.4. The Executor and the Client will hereafter in the Agreement be referred to as the Parties.

1.5. The Parties recognize this Agreement, posted in electronic format, as legally equivalent to an agreement confirmed in written form.

1.6. The Agreement is recognized as a public offer, the action of which applies to the territory of the Executor’s service provision. The conclusion of the Agreement is conducted under the terms of a public offer. The Client agrees to the terms while applying on the Ant.Exchange website to use the services provided by the service.

1.7. The Executor reserves the right to change the provisions in this Agreement by publishing such amendments on the website.

1.8. All disputes and disagreements arising between the Parties shall be resolved through negotiations. If an agreement cannot be reached, disputes are considered in accordance with the legislation of the jurisdiction where Ant.Exchange is registered.

2. Essence of the Agreement

2.1. The Executor provides the Client with a set of services (listed in section 4 of this Agreement) in accordance with the Regulations (section 5 of the Agreement) provided that the conditions (section 9 of the Agreement) are fulfilled.

2.2. The Client uses the services of the Executor and pays for them according to the terms of this Agreement.

2.3. The Executor is not responsible for possible financial losses of the Client if they are caused by changes in cryptocurrency or fiat currency exchange rates during the exchange operation.

3. Rights and Obligations of the Parties

The Executor shall:

3.1.1. Provide the Client with exchange services regarding funds from payment systems such as Perfect Money, Advanced Cash, Payoneer, Payeer, and others, in accordance with the regulations and rules of this Agreement.

3.1.2. Provide the Client with support—informational and technical, related to the services of the Executor.

3.1.3. Store all data (including transaction amounts, addresses, personal information) related to the Client’s exchange transactions.

3.1.4. Keep confidential and not disclose to third parties data regarding exchange transactions.

3.1.5. Maintain accurate statistics on Client transactions and provide a discount in prescribed cases.

3.1.6. In cases where funds have not been received, the Service Provider shall process a refund or complete the transaction no later than 72 hours from the moment the complaint is submitted, unless otherwise specified. This period applies in exceptional cases such as technical failures or delays from payment providers.

3.1.7. Request additional documents from the Client for identity verification and source of funds verification when necessary.

4. Provided Services

4.1. The Executor provides exchange of electronic funds, including operations with Perfect Money, Advanced Cash, Payoneer, Payeer.

4.2. The Executor does not verify the legality of the Client’s ownership of funds for exchange.

4.3. The Service Provider does not offer exchange services for funds related to the Russian Federation. Exchanges involving Russian exchanges or wallets that have direct or indirect ties to the jurisdiction of the Russian Federation will not be processed. Such transfers may be rejected or returned to the sender.

5. Electronic Money Exchange Regulations

5.1. The exchange process begins only after the full amount has been received from the Client.

5.2. Once initiated, an exchange cannot be canceled.

5.3. If the funds are not received within 30 minutes, the request will be canceled.

5.4. If the exchange rate changes by more than 0.5%, the exchange will be carried out at the current rate at the time of full payment.

5.5. The Client understands and agrees that the exchange rate is fixed only at the moment when the full amount has been credited to the Provider’s account. All rates displayed on the website prior to actual receipt of funds are for informational purposes only and may change according to market conditions.

5.6. If the payment amount differs by more than 10% from the declared amount, the request may be canceled.

5.7. If incorrect payment details are provided, the exchange may be suspended.

5.8. The Client must indicate only their own payment details in the request. Transfers to third-party accounts are prohibited. In the event of a violation, the Provider has the right to suspend the request and freeze the received funds for up to forty (40) calendar days. After this period, the funds will be returned to the original account.

5.9. The Service reserves the right to cancel any ongoing transaction and return the electronic currency and/or funds deposited by the User without explanation. Such a cancellation may be due to technical failures, software errors, issues on the side of payment providers, or force majeure circumstances. The refund will be made to the original payment details.

5.9.1. The Service Provider is not responsible for any losses or consequences if the Client transfers funds to outdated payment details or via the wrong network. Each exchange request is assigned unique payment details that are valid only for the designated payment window. After this period, the details become invalid and may be reassigned to other users. In the event of an erroneous transfer, if a refund is possible, it will be processed with the deduction of any fees charged by the exchange, aggregator, or other intermediaries. All risks in such cases are borne solely by the Client.

5.10. The Service Provider reserves the right to suspend or cancel an exchange request if, during processing, a significant discrepancy is found between the requested exchange rate and the actual market rate at the time of processing. This includes cases where the rate was formed artificially or as a result of technical errors, incorrect data uploads, or arbitrage actions.

Processing of a request is defined as the final confirmation by the Service Provider’s operator after verifying full receipt of funds and their compliance with the terms of this Agreement.

In such cases, the Client may be offered one of the following options:

– to proceed with the exchange at the actual rate of the service at the time of processing,

– or to receive a full refund without any fees deducted.

6. Responsibility of the Parties

6.1. The Executor disclaims responsibility for Client errors when filling out the exchange form.

6.2. The Executor is not responsible for losses caused by Client equipment malfunctions.

6.3. The Service Provider shall not be held liable for delays or failure to complete transactions in cases of force majeure, including failures of payment systems, internet outages, cyberattacks, changes in legislation, or actions of third parties.

7. Mandatory Conditions for Conducting Exchange Operations

7.1. It is forbidden to use the service for fraud or illegal operations.

7.2. The administration has the right to provide information to competent authorities in the case of proven fraud.

7.3. The Client must use only their own wallets and is responsible for the source of funds.

7.4. The service is not responsible for exchange operations performed for the benefit of third parties.

7.5. Consent to the rules is confirmed by clicking "I agree with the exchange rules."

8. AML Policy

8.1. All transactions are checked as part of AML (Anti-Money Laundering).

8.2. Security protocols are used to block prohibited accounts.

8.3. Transactions are checked for connections to illegal resources.

8.4. The Executor has the right to refuse service to a client without explanation.

8.5. Transactions may be blocked or sent for additional verification.

8.6. Information is passed to third parties only at the request of competent authorities.

8.7. Transactions that have a direct or indirect link to Russian exchanges, wallets or payment systems may be blocked and subjected to additional AML checks. The Service Provider reserves the right to reject or return such payments without explanation.
